Harvard University’s attempt to throw out a lawsuit accusing the Ivy League institution of perpetuating antisemitism has been firmly rejected.

U.S. District Judge Richard Stearns issued a 25-page ruling on Monday that criticized Harvard’s handling of what he termed an “eruption of antisemitism” on campus.

“The protests were, at times, confrontational and physically violent, and plaintiffs legitimately fear their repetition,” Stearns wrote in his ruling. “The harassment also impacted plaintiffs’ life experience at Harvard; they dreaded walking through the campus, missed classes, and stopped participating in extracurricular events.”

According to the federal lawsuit filed by six Jewish students in January, Jews at Harvard have been physically assaulted, spat upon, and threatened with violence simply for expressing their support for Israel.

Perhaps most disturbing is the alleged complicity of some Harvard faculty members in this campaign of hatred. The lawsuit contends that professors have used their classrooms to spread anti-Israel propaganda and have even gone so far as to encourage Hamas sympathizers to engage in physical intimidation and violence against their Jewish peers.

Harvard had sought to dismiss the lawsuit in March, arguing that it had taken tangible steps to investigate and tackle antisemitism.

However, the judge was unconvinced by Harvard’s defense. He stated that accepting the university’s argument would “reward Harvard for virtuous public declarations that, for the most part, proved hollow.” He also characterized the school’s reaction as “at best, indecisive, vacillating, and at times internally contradictory.”

While Stearns did not actually rule on the antisemitic allegations in the lawsuit, he did conclude that the case will move forward because the plaintiffs had “plausibly pled” the existence of an abusive environment toward Jewish student on campus.
